DID YOU KNOW...
…that contractors who use subcontractors can incur a liability exposure for bodily injury or property damage caused by that subcontractor? If the subcontractor is found to be negligent, the contractor may be liable for all or part of the loss depending on the nature of the loss and evidence of liability insurance protection.
The best way a contractor can manage this exposure is to hire experienced, well managed subcontractors who produce quality work, have excellent loss experience, and provide a Certificate of Insurance for liability insurance with limits equal to those carried by the contractor.
Evidence of a properly insured subcontractor does not totally eliminate the contractor’s exposure to loss, so there will be a liability charge for any subcontracting exposure. If proper evidence of insurance is available, the charge will be assigned to a subcontracted work classification. However, if the Certificate of Insurance is not available at the time of a premium audit, or the limits of insurance carried by the subcontractor are lower than the insured contractor's limits, the charge will be the full rate assigned to the subcontractor’s trade, such as carpentry or plumbing.
